Truck driver in Chi-Hi bus crash walks free

HUDSON - More than 18 months after the bus crash that killed five people, including a UW-Eau Claire student, the semi-truck driver involved in the crash has been cleared of all charges.
In less than four hours of deliberations, a jury found Michael J. Kozlowski, 24, of Schereville, Ind., not guilty Monday afternoon on all 33 criminal charges he faced.
Kozlowski faced five counts of homicide, seven counts of reckless driving causing bodily harm and 21 counts of reckless driving resulting in injury for what Eau Claire County District Attorney Richard White called Kozlowski's negligent role in the accident.
The truck Kozlowski was driving overturned on Oct. 16, 2005, on Interstate 94 just north of Osseo. A bus carrying members of the Chippewa Falls High School marching band then crashed into the truck, resulting in the deaths of five people, including former UW-Eau Claire senior Branden Atherton.
Judge William Gabler ordered the court to release Kozlowski under the conditions of his signature bond.
